“It is more profitable to compromise” in Russia blocked the social network LinkedIn REGNUM

Moscow, 10 November 2016, 22:41 — REGNUM the Company we may take advantage of the opportunity to appeal the decision of the court, — such opinion was expressed to the correspondent of the REGNUM lawyer Nadezhda Yanovskaya, commenting on the court’s recognition of the legitimate blocking of the social network LinkedIn.

the Expert explained that was not so long ago changed certain provisions of the Federal laws “On information, information technologies and protection of information” and “On communication”, the legislator has enacted “organizers of information distribution” (registered as such in Roskomnadzor) to store data in the territory of the Russian Federation. This is the so-called localization of data centers in Russia — data about our users on the network were physically in Russia (that is, the equipment on the territory of the country).

“So, Roskomnadzor has begun check of execution of requirements of these major players. Enough time has passed to market participants accustomed to the new rules and adapt to them — they did not check immediately after the amendments come into force. Now the experts rightly point out that this is the first serious test of big business on the implementation of this law. LinkedIn is the argument that information is stored and processed not in the United States of America, and in Ireland, in this case, solve nothing,” — said Yanovskaya.

However, the lawyer stressed that the path is not finished yet — the company still can appeal the decision of the court of appeal in cassation.

“it is possible that the company’s more profitable to compromise and change the strategy against Russia, because, despite the view that users of LinkedIn are not so many, it is unlikely that the network would want to lose such a big market. It should also be noted that Roskomnadzor explained that he had twice sent requests to the company with the requirement to provide information about execution of the legislation on data localization in Russia. And only after the company ignored those requests, the Supervisory authority asked the court to lock the resource,” she concluded.

Recall, 10 November the Moscow city court has issued a decision to recognize the legal lock on the American social network for networking and job hunting LinkedIn.
